Ninth Circuit Vacates Amazon’s Preliminary Block on Perplexity’s Comet

The Ninth Circuit has removed Amazon’s temporary legal block on Perplexity’s Comet shopping assistant, finding that Amazon was unlikely to prove the AI company itself accessed Amazon’s computers. The August 4 opinion vacated the preliminary injunction and returned the case for further proceedings.
That is a consequential but narrow win for Perplexity. The panel decided how the federal anti-hacking law and California’s comparable computer-access law apply to this technical setup at the preliminary-injunction stage. It did not decide that a company is insulated whenever its AI agent acts at a user’s request.

The court focused on the route to Amazon’s servers
Amazon.com Services operates the Amazon Store, including password-protected customer accounts that can hold payment and delivery information, order histories and returns. Perplexity AI is the startup behind Comet, a browser it developed after acquiring browser company Sidekick and released in 2025. Comet operates locally on a user’s machine like a conventional browser; its optional Assistant is the feature Perplexity says can perform user-directed tasks, including shopping.
That architecture drove the ruling. When a user asks the Assistant to find an item, the assistant takes screenshots of the browser view and sends them from the user’s computer to Perplexity’s servers. Perplexity’s servers send back instructions for navigating Amazon.com. The court concluded that chain did not show Perplexity had entered Amazon’s servers; it showed a user accessing them with an AI tool.
The distinction was decisive under the federal Computer Fraud and Abuse Act, or CFAA, which the court described as principally an anti-hacking statute. Amazon had to show, among other elements, that Perplexity intentionally accessed a protected computer without authorization. The panel said Amazon was unlikely to establish that initial access element on the record before it. It reached the same result on the California Comprehensive Computer Data Access and Fraud Act, despite Amazon’s argument that California’s definition of access is broader.
