Commissioner of Public Lands Stephanie Garcia Richard on July 14 rejected Energy Transfer’s request to reconsider two pipeline rights-of-way and a business lease associated with Project Jupiter in Doña Ana County, according to the decision letter. The State Land Office had canceled the applications on March 20.
The requested crossings covered about 2,000 feet of a southern segment and 3,200 feet of a northern segment of the proposed 24-inch Green Chili Lateral. Together, that is roughly 5,200 feet, or about 6% of the approximately 17-mile route. A separate lease would have covered a meter station connecting the lateral to an existing El Paso Natural Gas line.
The small physical share does not make the applications incidental. The commissioner said the pipeline was expected to carry 400 million cubic feet of gas per day to the data center. Oracle separately confirms that Project Jupiter’s revised onsite power system will use natural gas. The retained evidence does not, however, establish that denying these parcels is equivalent to denying the entire pipeline.
Energy Transfer’s affiliates argued that their applications were complete, properly filed and accompanied by the required fees. Garcia Richard said those steps did not entitle them to trust land: her office must decide whether a grant serves the trust’s beneficiaries. The proposed five-year use would have produced $43,406 in annual payments to the State Land Office, the letter said.
That is a narrower test than whether Project Jupiter might create benefits elsewhere in New Mexico. The commissioner’s stated duty is to the land trust, which supports schools and other public institutions. Her conclusion was that the direct return to that trust did not outweigh the environmental and resource burden she attributed to the project.
The ruling still leaves process rather than finality. Energy Transfer may petition for an administrative contest within 30 days of the letter.
The chronology matters because it changes the causal claim. A June 18 industry analysis said it had moved the STACK Infrastructure and Oracle site to 2029. The State Land Office did not deny reconsideration until July 14. The later decision reinforced the unresolved land problem; it could not have prompted an estimate published nearly four weeks earlier.
The competing dates also describe different milestones. The analysis cites Oracle’s June 10 earnings call as saying customer delivery in Doña Ana County would begin in the first half of calendar 2027. The analysis then moves its own base case for first power out of 2027 and into 2029. Treating those milestones as interchangeable would imply more precision than the sources support.
The analyst’s case rests on a sequence of obstacles, not just the July letter. It says the original two gas-turbine microgrids faced extended state air-permit reviews after questions about enforceable emissions limits and thousands of public comments. The turbine applications were withdrawn on April 27 and replaced with a Bloom Energy fuel-cell design. The analysis also says the March 20 land rejection forced a reroute, federal regulators opened a fuller Section 7 review in May, and subsequent sworn filings found no viable alternative route.
Those federal and route conclusions come through the analyst’s account of the records, not from a retained federal filing. Its broader forecasting system combines filings, satellite imagery and other research, and the publication says the full methodology is not publicly disclosed. The 2029 date is therefore a reasoned but proprietary estimate that cannot be independently reproduced from the retained material.
No retained company statement adopts that estimate. The evidence instead leaves a two-year gap between Oracle’s stated customer-delivery target and the analyst’s first-power base case.
Oracle says it replaced gas turbines and diesel generators with Bloom Energy fuel cells after residents questioned the original plan. In the company’s explanation, it estimates that the new design will reduce nitrogen-oxide emissions by approximately 92% compared with the original plan and substantially cut several other local air pollutants.
That comparison is a company projection against a superseded design, not a measured result from an operating campus. The project has not yet begun operations.
The redesign also does not remove the immediate fuel dependency. Oracle says the system “will use natural gas today.” It says the fuel cells could later use hydrogen or biogas if those fuels become commercially viable, and could support carbon-capture applications more readily than combustion systems. Those are possible future options, not current substitutes for the gas supply.
Oracle describes a more-than-2-gigawatt power resource with redundancy, operating behind the meter and paid for by the company. It says the planned grid connection is a small substation intended mainly for the office building, initial ramp and equipment commissioning, with limited emergency backup. The current design therefore does not present the regional grid as a replacement for the campus’s main power source.
The environmental figures in the dispute are not like-for-like measurements. Garcia Richard’s letter says Project Jupiter is expected to emit more than 10 million tons of greenhouse gases per year even after the fuel-cell change, citing the project’s permit applications. It also repeats an outside report’s estimate that the campus would use nearly 1 million gallons of water per day. These are estimates cited by the commissioner, not observed results.
Oracle’s narrower water claim is that fuel cells use water for startup and limited maintenance but not during normal operation. It also says no community drinking water will be used for cooling or fuel-cell operations. That does not directly rebut a campus-wide daily-use estimate unless both calculations include the same systems, water sources and operating assumptions. The retained sources do not provide enough underlying data to reconcile them.
Likewise, a projected 92% reduction in nitrogen oxides relative to the turbine plan does not answer the commissioner’s concern about total greenhouse gases. The pollutants, baselines and policy questions differ.
Three kinds of evidence could close the gap between Oracle’s 2027 statement and the analyst’s 2029 forecast: an administrative result that changes the state-land decision, an authorized gas route and federal approval, or a revised power plan that no longer depends on the disputed lateral. A new delivery schedule from Oracle would show how the company itself has absorbed the permitting changes.
Until then, the July 14 ruling is best understood as another constraint on an unresolved fuel route. It is not proof that Project Jupiter is dead, and 2029 is not an official opening date. The central question is whether the developers can document a permitted gas-supply path soon enough to preserve Oracle’s stated customer-delivery timetable.
